Curious Techie..Core is you and me and dont post such things..but for the core EB-2 would not have been in a postion that it is today..they worked to get this done...you can request them in thier next meeting to bring this issue with USCIS\

What happens when one filed labor under software engineer and then uses AC21 to switch jobs to a different company with a different job description like architect, product technologist or technical product manager.
The job description says designs architects and develops software. A product tecnologist,product manager or architect can be doing the same work in addition to other job functions.

I am in the process of applying for EAD renewal. I have few questions:
On the I-765 form,
Q.11 if applied for EAD before , complete below.
But there is nothing below other than your signature and date. It does not ask you of previous EAD information. What does "complete below" means?
Q.16 The Eligibility here would (c) (9) for I-485 applications correct?
Where do I mail this application . My AOS is pending at TSC.

Mailed to NSC on May 31st.
Received at NSC on June 1st (I think... never took tracking# from attorney).

There is no references in INA showing EB dependents must be counted in EB quota. period.
INA doesn't talk about visa allocation for spouse and children in employment pref. So we need to atleast challenge CIS interpretation on this.

Section 205. Retaining Workers Subject to Green Card Backlog.
Allows foreign workers who have started the green card process, but who are subject to green card backlogs, to pay a $500.00 supplemental fee to file an application to adjust status. This change would enable foreign workers to remain in the U.S. until the green card becomes available
Section 201 item two says exemption for all advanced degree holder who worked in US for atleast 3 years in a "related" field. I know there might be issues with definition of "related" but seems job can be EB2/EB3 as long as the beneficiary has an advanced degree and the job is in related field - they are exempt. Am I reading it correctly? I think is how its in STEM right now. A very good back bill for us (if CIR fails to materialize).

My friend sent her package on may 18th and she saw on uscis that they dated the receipt as june 1st... so that can give you an idea.
I sent mine on June 1st....nothing yet.
on june 6th the immigration.com breaking new claims there is a backlog of receipt for up to 45 days.
I am expecting to get mine at least by june 30th because with the flood of applications on july first....whoi knows

Immigration-law.com just reported that "As reported by the USCIS, the Service Centers are currently experiencing the receipting frontlogs. In some cases, there are frontlog of 45 days or longer...".

This is not a personal advice but general appeal to all would be employers.
I hope you have researched and understood obligations of an employer.
By virtue of owning the business and taking 100% of returns, the employer has to assume 100% risk.
If not on revenue sharing with employee ( 80-20 etc) , the employer has no business of NOT paying on bench. Either the employee is on rolls or has to be advised to take LOA or let go.
For other unprofessional tactics, there is simply no excuse. Employment is at will. If employers cant deal with that, too bad. They should not be starting the business.
I have worked with Desi employers who have consistently run on best practices and completely adhering to law of the land. It can be done and the cost of doing that has to be factored into the business plan. If it is too costly as per your financial numbers, then you are not ready for it financially.
There is moral obligation too. Whenever you hire H-1s make sure most of them have dreams to get GC and settle down. Dont take risks in such a ways their dreams get shattered because of poor business practices. just to hire people dont run in your businesses on losses and in turn force yourself to shut down the business.

On the one side you have the EB2. Earning more, and better educated. Clearly more important human beings to IRS and society. On the other we have EB3 Junta trying to get what they think is their right to spillover.
Now I understand all your points and agree with all of them.
Only 1 question :D why is IV not fighting to increase the regular (non spillover) quota for the clearly better category EB2. This is clearly not fair such super humans having to share same numbers as lower categories. Lower categories should go to Bombay where there is one apartment which is still empty.
Or better still get rid of the EB3 category altogether. Problem is solved! :D
